Petition 7: the Nardone Petition

This petition may not look like much, but there is a horrible story behind it. Ms. Nardone came to the Ad-hoc Redress Caucus in June 2010 and told us a shocking tale. I think I tossed my extensive notes when I resigned in August 2010— but maybe I merely misplaced them. Even with the notes, I couldn't do her story justice anyway. The gist of it is:

Hope Nardone is a single adoptive mother of two biological siblings whom she rescued from an orphanage in Belarus circa 2005. The little girl who was born in (I think) 1997 turned out just fine, but the boy who was born in 2001 has been acting out in extreme ways. Ms. Nardone turned to the system for help, but she herself was accused of abuse and neglect. To make things even worse, the official reports describe her son as a boisterous but basically normal little boy: they only report normal little-boy behavior. On the hand, the state wants to give him psychotropic drugs— and Ms. Nardone has very different ideas on what he should be treated for and how he should be treated.

PETITION FOR REDRESS OF GRIEVANCE

SUBJECT: Grievance of Hope Nardone


Whereas, the New Hampshire Bill of Rights at Article 2, Part First of the New Hampshire Constitution provides that "All men have certain natural, essential, and inherent rights - among which are, the enjoying and defending life and liberty; acquiring, possessing, and protecting, property; and, in a word, of seeking and obtaining happiness. Equality of rights under the law shall not be denied or abridged by this state on account of race, creed, color, sex or national origin;" and

Whereas, the New Hampshire Bill of Rights at Article 12, Part First of the New Hampshire Constitution provides that "Every member of the community has a right to be protected by it, in the enjoyment of his life, liberty, and property;" and

Whereas, the New Hampshire Bill of Rights at Article 32, Part First of the New Hampshire Constitution provides that "The people have a right, in an orderly and peaceable manner, to assemble and consult upon the common good, give instructions to their representatives, and to request of the legislative body, by way of petition or remonstrance, redress of the wrongs done them, and of the grievances they suffer;" and

Whereas, the New Hampshire Bill of Rights at Article 31, Part First of the New Hampshire Constitution provides that "The legislature shall assemble for the redress of public grievances and for making such laws as the public good may require;"

Now, Therefore, your Petitioner, Representative Itse on behalf of Hope Nardone, hereinafter presents the particulars of her grievance against the State of New Hampshire, Department of Health and Human Services, Division of Children, Youth, and Families and invokes the constitutional authority and duty of the Honorable House of Representatives pursuant to said Articles 31 and 32 to bring about their redress:

  1. The Division of Children, Youth, and Families, after a request for assistance by Hope Nardone with [son's name redacted]'s emotional disturbances, pursued a petition against Hope Nardone for abuse and neglect.

  2. Based upon an initial founded determination, Hope Nardone was no longer able to engage in her profession as a Registered Nurse.

  3. Due to the inability to engage in her profession and the imposition of court-ordered services, Hope Nardone was eventually required to sell her home.

  4. The abuse and neglect case against Hope Nardone was eventually determined to be unfounded.



Wherefore, your Petitioner prays that the House of Representatives:

  1. Accept the within Petition for Redress of Grievance for enrollment and by vote of the House of Representatives appoint a committee to hold public hearings and examine the circumstances hereof; and following such hearings and examination, recommend to the full House of Representatives that it:

  2. Insert a line item in the Department of Health and Human Services appropriation for the biennium ending June 30, 2011 an amount sufficient to reimburse your Petitioner for the loss of her home and income.
